Campus Judicial Process
All Indiana University Students enter into an contract and commit to upholding certain standards of academic and personal conduct as defined by the Code of Student Rights, Responsibilities, and Conduct. When allegations surface that a student has violated these standards, the Campus Judicial Process, overseen by the Dean of Student's Office of Student Ethics.

Summary of Disciplinary Hearing Procedures

Introduction:

A student charged with violating University rules of personal misconduct shall be disciplined only in accordance with the following procedures

Judicial Notification Letter:

Disciplinary action against a student shall be initiated by the Dean of Students (or designee*) by the sending of notice to the student. Notice shall be sent to the address (physical and/ or electronic) as it appears in the official record provided by the student. The notice shall contain the specific regulation(s) with which the student is charged, the time, place, and a brief description of the incident. The notice will also summon the student to a judicial conference (for cases that are not Letter Only.) 
 

Judicial Conference:

The judicial conference will be held for the purpose of gathering information and answering questions which the student or the judicial officer may have. The student, however, need not answer questions or offer information, and a choice to remain silent will not be taken as an admission of responsibility. The student may have one and only one advisor or other counsel present during the conference. 
 

Hearing Commission:

The student may either consent to the determination of the sanction or, within the time specified in the decision letter, may request a formal hearing before the Hearing Commission. If no written request for a hearing is received by the Dean of Students within ten (10) calendar days after the date printed at the top of the decision letter, the sanction shall be imposed and the action considered final. If a hearing before the Hearing Commission is requested, the student will be notified of the specific time, place, and charges brought against him or her by the Dean of Students. The student will be able to read all reports about the incident and will be provided with a list of people who may be called as witnesses. If the student plans to present witnesses, he or she must prepare a list of the witnesses and submit the list to the Dean of Students no later than seven (7) calendar days before the hearing. The student is required to be present at the hearing and is entitled to present witnesses and to question witnesses.  
 

Review Board:

Following the decision of the Hearing Commission, the student may request an appeal with the Review Board within seven (7) calendar days after the date of the written decision of the Hearing Commission. An appeal may be initiated by filing a written notice of appeal with the Dean of Students, including a memorandum stating the reason(s) for believing the decision improper. The Review Board will not accept additional evidence, but will listen to the tape of the Hearing Commission and oral arguments as well as read written statements based on record. If a request for an appeal is not received by the Dean of Students within seven (7) calendar days after the date of the written decision of the Hearing Commission, the sanction specified by the Hearing Commission shall be imposed and the action considered final. 
 

Sanctions:

Sanctions may be imposed when a student is found responsible for a violation of University regulations, including: reprimand and warning; disciplinary probation; restitution; participation in a specific program; provision of a specific service; expulsion from University housing; transfer to a different residence hall or housing unit; deferred suspension, suspension or expulsion from the University. Failure to complete assigned sanctions can result in an additional allegation of a violation of the Code or being placed on the university checklist, which prevents future enrollment and access to other services of the Registrar’s Office.
